Article 1 – Definitions & Acceptance

By completing a reservation or occupying any accommodation operated as Pitaya Coliving (“Pitaya”, “we”, “us”), you (“Guest”) accept these Terms & Conditions, the House Rules (ADD LINK) and our Privacy Policy (ADD LINK). Together they form the “Agreement”.

Article 2 – Booking, Rate Plan & Payment

  1. Rate Plan. All bookings follow one flexible plan (“Standard Rate”).

  2. Deposit. Fifty per cent (50 %) of the total price is charged 30 days before arrival (“Deposit”).

  3. Balance. The remaining 50 % is due at check‑in.

  4. Payments are processed via Stripe; we accept Visa, MasterCard and AmEx.

  5. Prices are shown in euro (€) including VAT unless stated otherwise.

  6. Late balance: 5 % default interest.

Article 3 – Length of Stay

  1. Minimum stay: 10 nights.

  2. Maximum stay: 180 nights.

  3. Pitaya may waive these limits for published promotions.

Article 4 – Use of Card Details for Damages & Fines

  1. Guest authorises Pitaya to charge the payment card on file within 7 days of check‑out for:

    1. Physical damage, excessive cleaning, lost key (€50), smoking/vaping indoors (€200 fine).

  2. Pitaya will e‑mail photographic evidence and an itemised invoice before charging.

Article 5 – Cancellation, No‑Show & Re‑booking Refunds

  1. Free cancellation – cancel 30 days or more before arrival and receive a 100 % refund of all amounts paid.

  2. Partial refund – cancel 29 to 15 days before arrival; Pitaya retains 50 % of the total booking price and refunds the remaining 50 %.

  3. No refund – cancel 14 days or fewer before arrival, or fail to check in on the arrival date (“no-show”); Pitaya retains 100 % of the booking price.

  4. Re-booking credit – if any cancelled nights are resold and paid for the same dates, you receive a pro-rata refund for those nights.

  5. Refund timing – any re-booking credit is processed to the original payment method within 10 business days after the resold nights have been paid fully, minus non-recoverable bank fees.

Article 6 – Check‑In, Check‑Out & Stays

  1. Check-in and check-out times are flexible and will be confirmed according to real-time room availability.

  2. If a Guest requests to move to a different room after occupying the one originally assigned, a cleaning surcharge of €10 will apply

  3. Pitaya may reassign you to an equivalent unit within the property if necessary. Units are booked by room type, not specific rooms.

Article 7 – Use of Premises & House Rules (ADD LINK)

  1. Coworking space open 24/7.

  2. Quiet hours 23:00 – 08:00 property‑wide.

  3. Violation procedure: (a) verbal warning, (b) €50 fine, (c) eviction for persistent breach.

Article 8 – Pets & Assistance Dogs

  1. Pets and emotional‑support animals are not permitted.

  2. Assistance dogs (Real Decreto 409/2025) are admitted free of charge; official ID must be presented.

Article 9 – Safety & Security

  1. Do not tamper with fire‑safety devices; €200 fine + possible eviction.

  2. Smoking, vaping, candles and incense are prohibited indoors.

  3. Lock doors and windows.

Article 10 – Liability

  1. Pitaya is liable only for personal injury or loss caused by its negligence.

  2. Guest property left in common or otherwise unsupervised areas is at the Guest’s risk. Each room is equipped with a lockable door, and Guests are advised to secure valuables inside their room.

Article 11 – Force Majeure

Pitaya may cancel or curtail services without liability for events beyond reasonable control (e.g. volcanic ash, pandemic restrictions, power outages). Guests receive a voucher or refund for unused nights.

Article 12 – Privacy & Guest Register

  1. Pitaya collects personal data to manage bookings and comply with Real Decreto 933/2021 (traveller register). Data are stored 3 years and transmitted via SES‑Hospedajes.

  2. Legal basis: GDPR Art 6 (1)(b) (contract) and Art 6 (1)(c) (legal obligation).

  3. Data‑subject rights and DPO contact appear in the Privacy Notice.

Article 13 – Modifications

  1. Pitaya may amend non‑essential terms with 30 days’ notice on its website.

  2. If a change materially disadvantages a Guest with a future booking, the Guest may cancel within 14 days of notice for a full refund of unused nights.

Article 14 – Governing Law & Dispute Resolution

  1. Spanish law governs this Agreement.

  2. EU consumers may also sue in their home jurisdiction (Reg 1215/2012).

  3. Complaints to hello@pitayacoliving.com will be answered within 10 business days before further action.

Article 15 – Severability

If any clause is held invalid, the rest remains in force. These Terms replace all previous versions.
